TERMS OF SERVICE

1. AGREEMENT TO TERMS

By accessing or using Foreword (“the Service”) at tryforeword.com, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you (“User”, “you”, or “your”) and Foreword (“we”, “us”, or “our”). If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. DESCRIPTION OF SERVICE

Foreword is a done-for-you Instagram content service for small businesses. We learn your brand (from the details you give us and, with your permission, your public website and Instagram), then create Instagram posts and reels for you. You review every piece and approve, edit or reject it before it is used. Content is requested and paid for using credits.

You acknowledge and agree that:

• - Content is created with the help of AI systems run by independent third parties that Foreword does not control, and may need your edits before it suits your brand
• - You are responsible for reviewing content and for what you choose to publish
• - Foreword does not guarantee any particular reach, engagement, followers or sales
• - Content is delivered to your Foreword dashboard, and by email or Instagram message where we have agreed to do so

3. ELIGIBILITY

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are 18 or older and have the legal capacity to enter into a binding agreement.

4. ACCOUNT REGISTRATION

To access the Service, you must create an account. You agree to:

• - Provide accurate, current, and complete information during registration
• - Maintain the security of your account credentials
• - Notify us immediately at support@tryforeword.com if you suspect unauthorized access to your account
• - Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that contain inaccurate information, violate these Terms, or are used for fraudulent purposes.

5. FREE STARTER CREDITS

Every new account starts with 500 free credits. No credit card is required.

• - Free credits can be spent on posts and reels in the same way as purchased credits
• - Free credits have no cash value and are not refundable
• - We never charge you automatically after your free credits are used. You choose whether to buy more
• - We may limit free credits to one account per business to prevent abuse

6. CREDITS, PRICING AND PAYMENTS

What credits buy: 1 Instagram post costs 100 credits and 1 reel costs 200 credits.

Credit packs (one-time purchase):

• - Taster: 400 credits for ₹899
• - Starter: 1,000 credits for ₹1,999
• - Standard: 2,200 credits for ₹4,199
• - Studio: 4,800 credits for ₹8,999

Content Partner (monthly plan): ₹9,999 per month, which includes 4,000 credits each month and fully managed content. Plan credits renew every month and do not roll over. Credits from one-time packs never expire.

Prices are in Indian Rupees (INR). Prices include GST where applicable. We may change prices for future purchases with reasonable notice; the price you see at checkout is the price you pay.

Payments: Payments are made on our website at checkout and are processed by Razorpay, which supports cards, UPI, net banking and wallets. We do not see or store your full card details. Credits are added to your account once the payment is confirmed.

Content Partner renewal: The Content Partner plan renews automatically each month at the same price until you cancel. You can cancel at any time by emailing support@tryforeword.com, and access continues until the end of the paid month.

Refunds: We offer a 14-day refund on unused credits. The full terms are in our Refund Policy at tryforeword.com/refund.

7. ACCEPTABLE USE

You must not:

• - Use the Service to violate any applicable law or regulation
• - Attempt to reverse engineer or extract the source code
• - Use automated tools to bulk-download data beyond normal use
• - Impersonate any person or entity
• - Attempt unauthorised access to any part of the Service
• - Transmit malware, spam, or harmful content
• - Resell or sublicense the Service without written consent

8. INTELLECTUAL PROPERTY

The Service, including its design, code, algorithms, content methodology, and workflows, is owned by Foreword. You retain ownership of the content we create for you once you approve it, and of the brand information you give us. By using the Service, you grant Foreword a limited licence to use your data solely to provide the Service to you.

9. THIRD-PARTY SERVICES

The Service integrates with third-party AI providers (such as Anthropic and OpenAI) and infrastructure providers (Supabase, Vercel, Razorpay, Resend, Inngest). We are not responsible for the availability or accuracy of these services. Where content links to third-party websites, we do not endorse or control their content.

10. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT AI-ASSISTED CONTENT WILL BE ACCURATE OR SUIT YOUR PURPOSES.

11. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOREWORD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. FOREWORD'S TOTAL LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO FOREWORD IN THE SIX MONTHS PRECEDING THE CLAIM.

12. INDEMNIFICATION

You agree to indemnify and hold harmless Foreword and its officers, employees, and agents from claims arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. DISPUTE RESOLUTION

Informal resolution: Contact support@tryforeword.com first. We will attempt to resolve disputes within 30 days.

Arbitration: Unresolved disputes shall be settled by binding arbitration in Mumbai, India, in English, by a single arbitrator under the Arbitration and Conciliation Act, 1996 (India).

Class action waiver: You waive any right to participate in a class action lawsuit or class-wide arbitration.

14. GOVERNING LAW

These Terms are governed by the laws of India. You consent to the exclusive jurisdiction of the courts of Mumbai, India for matters not subject to arbitration.

15. CHANGES TO TERMS

We may modify these Terms at any time. For material changes we will update the “Last updated” date, post a notice on the website, and notify users by email at least 7 days before changes take effect.

16. TERMINATION

We may suspend or terminate your access at any time with or without cause. Upon termination, your right to use the Service ceases immediately. Account data may be deleted after a 30-day grace period.

17. SEVERABILITY

If any provision is found unenforceable, it will be limited to the minimum extent necessary and the remaining provisions continue in full effect.

18. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy at tryforeword.com/privacy, constitute the entire agreement between you and Foreword regarding the Service.
